No criminal decisions and only one juvenile decision this week. I actually have a limited legal role in In re A.R.R, 2014-Ohio-3367, though I am neither defense counsel nor appellate counsel.
The win goes to Charlyn Bohland at the Ohio Public Defender’s Office. A.R.R. was initially found guilty of four counts of rape of an eight year old. Because of the age of the victim, the court held a private hearing in chambers to determine her competency to testify. That competency hearing was not recorded. Everything in a juvenile delinquency case must be recorded, so this one gets remanded. Wright, Grendell, Rice.
